Montana State vows to re-examine policies

Montana State University will take a "serious look at itself," including its recruiting process, after two former athletes were charged with murdering another man. ... Gallatin County Attorney Marty Lambert -- whose father, Dobbie, coached basketball at MSU from 1955-62 -- said he doesn't believe the case speaks to problems in the university's athletics system or that it should reflect poorly on the school. "These are grown, adult men, who made their own decisions," he said.

Man receives 180 years for robbing, raping convenience store clerk

An illegal immigrant who pleaded guilty to robbing and raping a pregnant convenience store clerk last year was sentenced Friday to the maximum of 180 years in prison. ... His attorney, Mariah Eastman, called the sentence "clearly extreme." "It's essentially a death sentence by prison," she said, adding that she may ask for a sentence review. Eastman had asked District Judge Holly Brown to send her client to prison for 35 years. Gallatin County Attorney Marty Lambert lauded Brown's decision. "It's unfortunate we can't rely on the protection of our borders to safeguard us from people like Menjivar," he said.

Lambert raises legal issues about countywide zoning

The County Commission doesn't have the authority to zone the entire county just for housing density, and it can't allow the creation of new citizen-initated zoning districts once countywide zoning is in place, Gallatin County Attorney Marty Lambert has concluded.

Victims' families testify at murder hearing

Cowan was convicted of shooting his 62-year-old mother in the face seven times and aiding in the homicide of her boyfriend, Chester Reistad, 65, on Reistad's property just west of Bozeman on Feb. 20, 2003. ... Gallatin County Attorney Marty Lambert said Cowan should spend the rest of his life in prison with no possibility of parole.

Following Galvan's bail hearing, Deputy County Attorney Todd Whipple said bluntly that Montana's DUI laws are "absolutely not" strict enough. "They don't sufficiently hold drunk drivers accountable," Whipple said. While Gallatin County Attorney Marty Lambert agreed, he said the legal history of punishing drunken driving in Montana has traditionally hinged on balancing the state budget "as opposed to looking at crime and punishment."

Don't even bother looking for blood stains in the carpet. "The guy who's most likely to get you is armed with a keyboard," said Brian Fulford. "He has a computer and a business card, and he doesn't look anything like that guy your mother warned you about." ... Jury finds Hoffman guilty in baby-shaking case

Jurors found Justin Michael Hoffman guilty Thursday of felony assault for severely shaking his infant son last winter and causing serious injury to the boy. "…as a county attorney, I do believe that when a child is almost killed, a serious charge should apply." Lambert said during closing arguments.

Justin Michael Hoffman shook his 2 1/2-month-old son Logan last February hard enough for the boy to suffer a fractured scull and bleeding around the brain, both prosecutors and devense attorneys say. ... Hoffman and his with, Crystal, took their son to Bozeman Deaconess Hospital on Valentine's Day because the boy was pale, unresponsive and not breathing regularly, said Gallatin County Attorney Marty Lambert during opening statements.
